Claims Guide: How to make a faulty product personal injury claim

Monday June 28, 2010 at 10:12pm

The Consumer Protection Act 1987 imposes strict safety laws governing all products on the market.

However, some products that we use such as cars, toys for children, processed food, medicines, medical devices and cleaning products sometimes do not meet the strict safety standards and can be hazardous.

If you have become ill or injured as a result of a product that you have used, you have a right to make a claim for compensation provided you can show that the product was faulty.

Specialist Product liability solicitors will guide you through the process of winning your faulty product claim.

What you need to do after your faulty product injury

The six key steps you need to take are:

  1. Don’t destroy the faulty product that caused your illness or injury. Preserve it in its original state if possible. It will be useful evidence.
  2. If the product was in a packet, keep the packaging material. It may contain statements such as “New” or “Improved”
  3. Keep the users instructions or guide (if any) issued with the product.
  4. If you bought the product, keep the purchase receipt that was given to you.
  5. If the product was given to you as a gift, contact the person who purchased it and ask for the receipt or supplier’s details.
  6. Attend hospital or your GP as soon as possible.

Balinda & Co have many years experience and have helped a lot of people who have suffered injuries as a result of faulty products.
