Doctor’s Negligence claim: Go for full compensation

Wednesday September 14, 2011 at 6:19am
Anna, 56, successfully claimed compensation against the hospital after a doctor failed to diagnose her lung cancer.

She experienced very extreme pain for a long time because of the doctor’s failure to diagnose her cancer.

Anna was in pain for over three years, when her cancer was subsequently diagnosed. The condition had reached an advanced stage that her chances of recovery were compromised.

The doctor had failed to properly interpret the results of chest X-rays and a CT scan which were performed to diagnose the lung cancer. Once the hospital discovered this, they wanted to settle Anna’s claim for three thousand pounds.

Anna was still having difficulty coming to terms with her condition when the hospital wrote to her making their offer.

Anna’s husband, David knew someone who had successfully made a medical negligence claim against a doctor for failing to diagnose her breast cancer. The lady got a reasonable sum of money for her pain and suffering and other losses.

In Anna’s case, however, she lost her chance of recovery and her condition was serious. She had a good doctor’s negligence claim, and her husband knew it and went to a lawyer.

Because David had a friend who knew a specialist clinical negligence lawyer to contact, she got competent advice quickly.

The lawyer interviewed both Anna and David and found out more about the history of Anna’s condition and detailed facts about the events leading up to the failure by the doctor to diagnose her lung cancer.

As a result of the doctor’s mistake, Anna was in a lot of pain and was unable to resume work.

In fact, Anna was later advised that she may never return to her previous job as a curator.

Had David not gone to a lawyer, Anna would have been seriously under-compensated by thousands of pounds.

The employers of the doctor were to blame for his failure to diagnose Anna’s lung condition. Not only did they employ this man to treat patients but they failed to carry out due diligence about his suitability to practice medicine.

The doctor had been suspended by his professional body the General Medical Council and was facing disciplinary action, but they offered him a job as a locum.

Anna suffered irreparable damage and the hospital tried to settle her claim for a misery sum of three thousand pounds only. Fortunately David held out for a medical negligence claims lawyer.

While no amount of money can truly compensate a person for the pain and suffering caused by such medical failures, it’s only right that the victim should be awarded full compensation for their loss.

Families of loved ones such as David, who had to leave his job to look after his wife, should also be paid the amount that they have lost.

Full compensation can make it possible for victims of medical accidents to retain their homes as well. In the case of Anna she was not able to go back to work and David also gave up his job.

Anna’s lawyer helped her to get full compensation for the serious pain and suffering that shuttered her life.

Full compensation was possible for Anna because David knew not to accept the derisory amount the hospital offered her at first.

Anyone can learn from Anna and her medical negligence experience. She got compensated in full because her husband knew someone who had a clinical negligence claim.
