Does a child have a right not to be hurt while crossing a road or the parent should be blamed?

Can a child claim injury compensation if she was hit by a speeding car while crossing a road at a pedestrian crossing?

My child was knocked down by a car at a crossing? She has suffered serious injuries as a result of the accident, can I make a personal injury claim for her?

The simple answer is “yes”. You can claim compensation for your child for any injuries she sustained in a road accident or any accident. You are also entitled to claim any losses or expenses including care expenses you may have incurred as a result of your child’s injury.

The insurance company of the driver may try to blame you the parent or guardian on the basis that you should have supervised your child. In our experience such a defence hardly succeeds.

The World Health organisation (WHO) estimated that in 2005, 250 children died as a result of accident injuries. Almost half of these deaths were due to road accidents. In England, road accidents were responsible for approximately 101,000 hospital admissions.

Unlike adults, injury to a child can have long lasting impact on all her life. It may affect the child’s development, relationships, learning and play. It is a very heavy burden especially if the injuries are serious.

If your child has suffered injuries in a road accident as a pedestrian, she may be entitled to claim compensation for her injuries.

Because children needs are different from the needs of adults, their claims require specialist expertise. You will need the help of a specialist children injury lawyer to assist you make a claim for your child.

Balinda & Co have many years experience and have helped a lot of children who have suffered injuries in road accidents receive compensation they deserve.
