How much is my car accident personal injury claim really worth?

I got a rear end shunt with my girlfriend in the car and it was not my fault. But the other car did not stop after the accident. It sped off and I called the police.

I had to claim through the Motor Insurers Bureau (MIB). The total value of my car was £15,750 and for my girlfriends pain and injuries was £12,050 because she has a visible scar on her left arm and had a painful left knee for about one year. The compensation has already been paid off by the MIB. The MIB also sent my lawyer a cheque for me at £25,285 for my case and a cheque for my girlfriend’s case at £12,050. After paying the lawyer's fees I got £21,492.25 and my girlfriend got £10,242.50

The settlement Amount received: (Car £15,750); Injury compensation £9535; My total compensation was £25,285. My lawyer took 15% from this total. Then the MIB made a contribution towards my solicitor’s fees of £575. My lawyer's fee total was £4,367.75 for my case. The amount I took home was £21,492.25

My girlfriend’s settlement offer

The settlement Amount received: injury and pain £12,050. The solicitor took 15% from this total. Then the MIB made a contribution towards the lawyer’s fees of £575. The lawyer’s total was £2382.50 for my girlfriend’s case. The amount she took home was £10,242.50

Was this fair compensation for me and my girlfriend?

I think deducting 15% of your compensaiton isn't too bad, however I submitted a compensation claim with Thompons Personal Injury Solicitors and the maximum they charge is 10%, they promised it would not go over 10% which I was happy with. I contacted other law firms and claims companies and they were charging anything up to 40% of your compensation!!!

I agree Emma. I think 15% is sensible but in future I will shop around before instructing any solicitor.

Given the extent of some legal fees and the amount of compensation some road accident victims are left with, I think you haven't done too badly
