How much is my claim worth?

Understanding how much injury compensation you can claim helps you decide whether to make an injury claim.

Your compensation will be broken down into two main segments:

General damages
 
This phrase is used to describe compensation for pain, suffering and loss of amenity ( "loss of amenity" is a condition of being unable to pursue hobbies, take planned holidays etc).

The amount of general damages is somewhat based on previous cases where judges have determined the amount awarded.

The compensation you can expect to receive will depend on the type and extent of your injuries. For example, your typical neck injuries will fall into three categories:

(a) Severe neck injuries                  £95,000

(b) Moderate neck injuries               £12,375

(c) Minor neck injuries                     £3,875

These are average figures for your pain, suffering and loss of amenity. The actual compensation you will get will depend of the particular facts of your case.

Special damages

The important thing to note here is that you can only claim for expenses that you have incurred directly as a result of the accident you were involved in, and it is important to retain receipts, invoices etc as proof. The usual items on the special damages list are set out below:

(a) Loss of earnings
(b) Medical fees
(c) Medication/prescription charges
(d) Inability to drive /Travelling to medical appointments
(e) Relatives’ travelling expenses
(f) Domestic Assistance (Household help)
(g) Decorating/gardening/DIYetc
(h) Clothing
(i) Holidays/activities
(j) Other losses and expenses

The above list is not intended to be a complete list of possible items of claim. If there are any other losses or expenses which you think may be related to the accident, you should supply details and forward any receipts to your injury lawyer.

You should try to keep records and documents as proof of expenses. It is up to you to be able to prove the extent of your loss. Continue to keep a record of ongoing expenses.
