How to start a personal injury claim: What documents do I need?

It will be helpful, though not essential, for you to gather certain documents in preparation for your first contact with your injury lawyer.

Locate and copy your important documents, including:


1. Photographs of the scene of the accident (preferably colour photographs) taken from different angles.


2. A sketch plan showing the spot where the accident occurred and the direction you were taking.


3. Accident report form if your accident was at work or in a public place.

 
4. Your three months pay slips if you are employed. This will help in assessing your loss of income (if any).

5. Receipts for travel expenses incurred as a result of the accident.

6. Receipts for prescriptions charges incurred because of the accident.

7. Income tax returns if you are self employed. This will help in calculating your loss of income.

8. A list of names and telephone numbers of all the people who witnessed the accident.

9. Your car insurance, household insurance or credit car insurance documents. The purpose of giving these documents to your solicitor is to see if you have legal expenses insurance attached to either of these policies. If you have legal expenses insurance, your insurance company is under obligation to pay your legal costs instead of you signing a “No Win No Fee” agreement.

10. National Insurance Card or your NI number. This is required so that your claim can be registered with the Department for Work and Pensions (DWP). All personal injury claims must be registered with the DWP.


It will greatly help your injury lawyer if all the documents listed above are brought to your consultation. Your injury solicitor may ask for more documents based on the particular facts of your case.
