I fell and was injured in a supermarket, how much is my claim worth?

Tuesday October 18, 2011 at 6:46am
I slipped and fell in my local supermarket while shopping. As a result of the accident, I hurt my back and wrist.

I saw my GP and was prescribed pain killers. It’s now six months since the accident and I am still having back pain but the pain in my wrist is not as bad. I was off work for just over a month.

How much do you think my claim is worth?

A claim for injury compensation including injuries suffered in a slip and trip accident in a supermarket will have two elements:

1. General Damages

This is the compensation you will receive for pain, suffering and loss of amenity (being unable to pursue hobbies or to take planned holidays etc). The amount of general damages will be based on previous cases where a judge determined the amount awarded.

It’s difficult to give you precise figures but please look at our “How much is my claim worth” guide for the likely amount you may receive for this aspect of your claim.

2. SPECIAL DAMAGES

Losses such as out of pocket expenses you incurred because of the accident or your loss of earnings and are classified as special damages. You will only claim for expenses that you have incurred directly as a result of the accident you were involved in, and it is important to retain receipts, invoices etc as proof. Please see below a list of the usual heads of special damages:

• Loss of earnings
• Medical fees
• Medication/prescription charges
• Inability to drive /Travelling to medical appointments
• Relatives’ travelling expenses
• Domestic Assistance (Household help)
• Decorating/gardening/DIYetc
• Damaged or destroyed clothing
• Holidays/activities
• Other losses and expenses

If you have suffered any other losses or expenses (not included in the list above) which you think may be related to the accident, you should supply details and forward any receipts to your injury lawyer as proof.

Please keep records and documentary proof of expenses. It is up to you to prove the extent of your loss. It is important that you continue to keep a record of ongoing expenses.
