Personal Injury Claims: How much is my claim worth?

I slipped and fell on an uneven paving just outside my house while coming from work in the evening.

 A lot of people have had accidents on this pavement and my neighbours and I have complained to the Council about it several times but nothing has been done to repair it.

As a result of the accident, I hurt my back and ankle.

My son has taken photos of the defective paving showing the terrible condition of the entire stretch of the road.

Following the fall I saw my GP and was prescribed pain killers. It’s now nine months since the accident and I am still having back pain and pain in my ankle.

I was off sick for two weeks and when I returned to work I was having problems and I continue experiencing difficulties sitting and walking.

How much is my personal claim is worth?

Compensation for Personal injury claims is assessed in two stages:

1. General Damages

A claim for general damages consists of the compensation you receive for the pain, suffering and loss of amenity (being unable to pursue your hobbies or to take planned holidays etc).

The assessment will be based on previous cases where a judge determined the amount of compensation awarded.

2. SPECIAL DAMAGES

Other losses such as out of pocket expenses you have sustained as a result of the accident are called special damages.

This element of your claim will only cover expenses and losses that you have incurred directly as a result of the accident you were involved in. It is important to keep receipts, invoices etc as proof.
