Work and industrial disease and illness compensation

What should I do if I feel my illness is due to the conditions at work?

1. Seek Advice

If you are suffering from work related disease and you think it is because of the conditions at your workplace, you should seek advice from a doctor and then a specialist industrial disease solicitor. Even if the advice is that your illness was not caused by the conditions at your workplace at least you will have a peace of mind in knowing that you sought that help.

2. Monitor your Condition

If the symptoms improve or stop when you are not at work, for example, when you are off sick or on holidays, this might be proof that the cause of your problem is work related.

3. Keep a Record

If you make a complaint to your employers about the work conditions prior to the development of your symptoms, this will help your case. We will be able to obtain a copy of your complaints record or any complaints made to your employers by your colleagues. This will be able to show that your employer could reasonably have foreseen the risks of the disease that you suffered.

4. Time Limit

You only have 3 years to claim compensation from the date when you knew or reasonably ought to have known that your symptoms were caused by your employment. If the 3 years are passed, you may be time barred from pursuing your claim for compensation. There is discretion to extend the period but this can only be done in very limited circumstances.
