Faulty product compensation claims

Faulty products can cause injury and damage to you or your property. If you suffer injury, damage or loss as a result of a faulty or dangerous product you may be entitled to claim compensation.

Here are 5 common mistakes manufacturers of consumer products make:

  • Faulty wiring of electronic products. Manufacturers of electronic goods are required to make sure that the electrical components of the products they supply are safely arranged within the product. If the product you purchased had defective wiring, this could be proof that the manufacturers were at fault. If as a result you have suffered an injury by electric shock, you could be entitled to claim compensation.

  • Failing to have in practice a proper system of quality control. Manufacturers of consumer goods are required to have in place a proper system of inspection, checks and testing of their goods before putting them on the market.   • Failing to warn consumers of a defect in a product. Manufacturers are expected to warn consumers of a known or potential defect in products that they supply. Drug manufacturers are required to exercise proper care in the research and development of drugs to avoid harmful effects on patients.   • Failing to take proper care in the design and development of a product. Manufacturers are expected to take proper care in the design and development of their products, for example in the designing of cars or car parts. Beware, manufacturers rarely accept responsibility for accidents caused by faulty products but this does not mean that your claim will fail. They may be denying the claim because their insurance company requires them not to admit responsibility for policy reasons.

How to make your faulty product injury claim move faster

You must act quickly to preserve evidence after your accident.

Here are 6 key steps you must take after your faulty product injury:

  1. Don’t destroy the product that caused your injury or harm. Preserve it in its original state if possible. It will be useful evidence.

  2. If the product was in a packet, keep the packaging material. It may contain statements such as “New” or “Improved”.

  3. Keep the users instructions or guide (if any) issued with the product.

  4. If you bought the product, keep the purchase receipt that was given to you.

  5. If the product was given to you as a gift, contact the person who purchased it and ask for receipt or suppliers details.

  6. Attend hospital or your GP as soon as possible.
