How to prove your disease claim
Proving your disease claim requires you to show that your employers were at fault in exposing you to the dangerous conditions in your work place. The easiest way to do this is to show that they were at fault. You can do this in a number of ways.
Here are 5 common mistakes employers make:
- Failing to give employees proper information, instruction or training. Your employers have a responsibility to provide you with information, instructions or training or precautions to make you aware of the risks from asbestos. If you can show that they failed to do this, you may be able to prove that they were at fault. If as a result of the exposure you have suffered an illness or disease, you could be entitled to claim compensation.
- Failing to provide employees with suitable breathing protective equipment.
Employers are required to provide you with suitable breathing protective equipment to reduce the concentration of asbestos in the air you breathe in. If they have failed to do this you may be able to show that they were at fault. If as a result of the exposure you have suffered an illness or disease, you could be entitled to claim compensation.
- Failing to monitor the level of exposure. Employers must monitor the exposure to employees to asbestos. If they failed to do this, you may again be able to prove that they were at fault. If as a result of the exposure you have suffered an illness or disease, you could be entitled to claim compensation.
- Failing to provide proper extraction plant or equipment. Employers are required to provide proper plant or equipment to ventilate spaces or areas where asbestos might have been present in the atmosphere. If they have not done this, you may be able to show that they were at fault. If as a result of the exposure you have suffered an illness or disease, you could be entitled to claim compensation.
- Failing to make proper enquiries to get expert advice. If employers are aware or suspect the danger of asbestos dust and fibre, they must seek expert advice and act on the advice given. If they have failed to do this, you may be able to show that they were at fault. If as a result of the exposure you have suffered an illness or disease, you could be entitled to claim compensation.
Beware, employers defend claims against them. However, they may be denying the claim because their insurance company requires them not to admit responsibility for policy reasons.
